Subscription Service Agreement

Post Punk Publishing LLP (hereinafter referred to as the "Provider") offers any individual (hereinafter referred to as the "User") to enter into this agreement (hereinafter referred to as the "Agreement") for the provision of paid subscription services on the terms set forth below.

1. Definitions

1.1. Provider — Post Punk Publishing LLP, registered at Stoney Works, 8 Stoney Lane, London, United Kingdom, SE19 3BD.

1.2. Agreement — this document, published on the Internet at: foodgpt.doglabs.co/terms.

1.3. Service — the website foodgpt.doglabs.co and the associated Telegram bot @calories_foryou_bot.

1.4. Subscription — a paid period of the User's access to the Provider's Services.

1.5. Services — provision of access to the full functionality of the FoodGPT Telegram bot, including AI-powered food recognition, calorie tracking, and personal nutrition diary.

1.6. User — an individual who has accepted this Agreement.

1.7. Acceptance — full and unconditional acceptance of this Agreement by paying for the Subscription.

1.8. Content — features, data, and materials made available to the User through the FoodGPT bot under the Subscription.

1.9. Personal Data — information relating to the User: Telegram user ID, username, and other data provided during use of the Service.

2. Subject of the Agreement

2.1. The Provider undertakes to grant the User access to the full functionality of the FoodGPT bot, and the User undertakes to pay for the Subscription in accordance with the terms of this Agreement.

2.2. The Services are deemed to have been duly provided from the moment the User is granted access to the premium features of the bot.

3. Terms and Conditions of Service

3.1. To access the Services, the User shall:

3.2. The Agreement is deemed concluded at the moment the funds are credited to the Provider's account.

3.3. The Subscription is issued for the period selected by the User at the time of purchase. Upon expiration, the Subscription is automatically renewed by charging the User's linked payment method.

3.4. The User may cancel automatic renewal using the /cancel_subscription command in the bot no later than 3 (three) days before the next billing date.

4. Rights and Obligations

The Provider undertakes to:

4.1. Grant the User access to the premium features of the bot within 24 hours of payment confirmation.

4.2. Ensure proper quality of Services.

4.3. Notify the User of any changes to the terms of this Agreement no less than 3 (three) days before such changes take effect.

The Provider reserves the right to:

4.4. Modify the features, content, and functionality of the Service without prior notice.

4.5. Suspend or terminate the User's access to the Services in the event of a breach of this Agreement.

The User undertakes to:

4.6. Use the Service solely for personal, non-commercial purposes.

4.7. Pay for the Subscription in a timely manner.

4.8. Not attempt to circumvent the Service's technical restrictions or gain unauthorised access.

The User has the right to:

4.9. Cancel the Subscription at any time using the /cancel_subscription command in the bot.

5. Subscription Price and Payment

5.1. Subscription fees and available plans are displayed in the bot at the time of purchase.

5.2. Payment in Russian rubles is made by bank card via the CloudPayments payment system.

5.3. Payment in US dollars is made by bank card via the Stripe payment system.

5.4. When subscribing, the User links a bank card for automatic recurring payments. Charges are made on the date corresponding to the first payment.

5.5. If the charge fails, the Provider will retry within 3 (three) days. If the charge remains unsuccessful, access to the Services will be suspended.

5.6. The Provider reserves the right to change the Subscription fee by notifying the User no less than 3 (three) days in advance. The new fee applies from the next billing period.

6. Personal Data

6.1. The User consents to the processing of personal data in accordance with applicable data protection laws, including the UK Data Protection Act 2018 and the UK GDPR.

6.2. The Provider processes the User's personal data solely for the purpose of fulfilling this Agreement.

6.3. The Provider takes necessary measures to protect personal data from unauthorized access.

6.4. Full details of data processing are set out in the Privacy Policy available at foodgpt.doglabs.co/privacy.

7. Term and Termination

7.1. This Agreement takes effect upon Acceptance and remains in force until all obligations are fulfilled.

7.2. The User may cancel the Subscription at any time using the /cancel_subscription command in the bot. Access is retained until the end of the paid period.

7.3. The Provider may terminate this Agreement unilaterally if the User breaches its terms.

7.4. Refunds for the unused portion of the Subscription are processed upon request to support@doglabs.co within 10 (ten) business days.

8. Limitation of Liability

8.1. Neither party shall be liable for failure to perform its obligations due to force majeure circumstances.

8.2. The Provider shall not be liable for temporary interruptions in the Service caused by technical issues.

8.3. The calorie and nutrition data provided by the Service is approximate and for informational purposes only. The Provider shall not be liable for decisions made based on the Service's output.

8.4. The User is responsible for maintaining the security of their Telegram account and for all activities conducted through it.

9. General Provisions

9.1. Any disputes shall be resolved through negotiation. If a dispute cannot be resolved amicably, it shall be submitted to the courts of England and Wales.

9.2. Claims from the User shall be reviewed by the Provider within 10 (ten) business days of receipt.

9.3. The Provider reserves the right to amend this Agreement. Changes take effect upon publication on the Service.

9.4. In all matters not covered by this Agreement, the parties shall be governed by the laws of England and Wales.
